The participation of transgender athletes in sports has caused significant controversy in recent years. While many defend equal opportunities, others say Transgender athletes can have a physical advantage over CISGENDER competitors. This debate gained more attention before the Olympics of 2024, with some groups demanding a boycott. This year, several American universities have also decided to include a transgender athlete in the San Jose State team.

Utah State is the latest university that resigned from the competition against San Jose and joined three other schools that brought similar decisions at the beginning of the year. In a statement published this week, Utah confirmed its forfeiture of the match on October 23.

Unexplained reasons for forfeiture

While none of the universities explicitly linked their decisions with the presence of a transgender athlete in the enemy team, the University of Wyoming,   and other institutions that failed, mentioned that it was the result of a “lengthy discussion”. Utah’s statement explained that the Mountain West Conference policy would follow the match of the match.

San Jose State reacts..

The spokesman of San Jose State, Michelle Smith McDonald, dealt with the situation by saying that the university was unable to discuss the gender identity of students for the protection of personal data under the Family Educational Rights and Privacy. She also expressed disappointment that the students had been denied opportunities for the competition, and emphasized the school’s commitment to provide a fair and respectful environment for all athletes.

Speculation triggers controversy

The debate around Transgender athletes in San Jose began at the beginning of the year after speculation from a conservative website that quoted anonymous parents’ comments on a transgender player. This led to extensive legends that further stimulated controversy.

Lawsuit against ncaa

This question was escalated in legal proceedings. Several athletes filed a lawsuit against the NCAA and claimed that the IX head violation. Plaintiffs include Riley Gaines and Brooke Slusser, who claim emotional and physical distress due to their involvement in the Transgender athlete team. In particular, Slusser noted that the athlete revealed his gender identity in person and refused to use his preferred pronouns.

In response to this, the NCAA confirmed its obligation to the IX head, which promotes the integration and fair competition of all students, including Transgender Individuals.

This discussion raised concerns about the right to protect personal data of transgender athletes. Although the identity of the transgender athlete concerned has not been officially confirmed, the information about them was publicly discussed without their consent. Tony Hoang, Executive Director of Equality California, claimed that focusing on transgender athletes is part of a wider attack on the LGBTQ+ community, and this forfeiture eventually harms all participating students.

The debate surrounding the transgender athlete in sport is not new. In 2021, New Zealand Laurel Hubbard made history as the first openly transgender athlete who competed at the Olympics and caused extensive discussion. Hubbard participated in weightlifting and acknowledged controversy and expressed gratitude for the support received.

Although Hubbard did not finish the competition, her participation meant a significant moment in the ongoing debate on integration into sport. This topic remains questionable, with strong, divided views on both sides.
